CLARIFICATION OF PROCEDURES FOR HAND DELIVERING 2003 DART CLAIMS

On December 24, 2003, the Copyright Office published a Federal Register notice announcing procedures for filing claims to the DART royalty funds for the year 2003 (68 FR 74481). That notice indicated that private parties could deliver their claims directly to the Office of the General Counsel. That is no longer the proper procedure.

On February 9, 2004, the Copyright Office initiated a new procedure for delivering documents for the Office of the General Counsel, including all filings in a Copyright Arbitration Royalty Panel proceeding and claims to royalty fees administered by the Copyright Office (69 FR 5371, published February 4, 2004). The new procedure requires that a private party deliver all filings for the Office of the General Counsel and the Copyright Arbitration Royalty Panels to the Public Information Office, located in LM-401 of the James Madison Memorial Building.

To ensure that all claims are properly delivered during the statutory filing period, private parties who intend to hand deliver their claims should adhere to the following procedures:

If hand delivered by a private party, the claim should be addressed and delivered to:

Office of the General Counsel/CARP
U.S. Copyright Office
Library of Congress
James Madison Memorial Building, Room LM-401
First and Independence Avenue, S.E.
Washington, D.C. 20559-6000

If hand delivered by a commercial courier, the claim should be addressed as above, but delivered to the Congressional Courier Acceptance Site (CCAS) located at Second and D Streets, N.E., between 8:30 a.m. and 4:00 p.m.

These instructions differ slightly from the current regulations, which direct a claimant to address the claim to the Register of Copyrights. In light of the new procedures, claimants are to disregard 37 CFR Sec. 259.4(a)(1) and follow the instructions set forth herein. All Copyright Office regulations are currently under review and will be amended in the near future to reflect the new procedures.

Mar. 1: Deadline for receipt of claims to the 2003 DART royalties. However, note that the Office encourages claimants who file online to do so by February 29, 2004. Claims filed online must be received on the Office's server by 11:59 p.m. EST on March 1, 2004.
