REQUEST FOR COMMENTS ON ENCRYPTION/SECTION 1201(g) 64 FR 28802
The Copyright Office and the Department of Commerce published in the Federal Register on May 27 a request for comments on the effects of section 1201(g) of title 17 (the Copyright Act, as amended). Comments are sought for use in preparing a report due to Congress this fall, as mandated by the Digital Millennium Copyright Act (DMCA). Comments are due July 26, 1999, and may be submitted in either paper or electronic form.

Title 1 of the DMCA, which became law Oct. 28, 1998, adds a new chapter 12 to title 17, to provide adequate and effective protection against circumvention of technological measures used by copyright owners to protect their works. The DMCA, however, permits specified activities that include the circumvention of access control technologies in limited circumstances, including encryption research. The Copyright Office and the Commerce Department's National Telecommunications and Information Administration are seeking comments on encryption research and the development of encryption technology; the adequacy and effectiveness of technological measures designed to protect copyrighted works; and the protection of copyright owners against unauthorized access to their encrypted copyrighted works. More specifically, comments are sought on how the provisions of section 1201(g) will affect encryption research.
