OFFICE INITIATES PROPOSED RULEMAKING ON RECONSIDERATION OF REFUSAL TO REGISTER

The Copyright Office is publishing a notice of proposed rulemaking that would codify and make minor modifications to the procedures announced in 1995 (60 FR 21983) governing requests by applicants that the Copyright Office reconsider refusals to register copyright claims. The notice extends these procedures to refusals to register claims in mask works or vessel hull designs, changes the name of the Copyright Office Board of Appeals to the Review Board, and provides that a decision by the Review Board constitutes final agency action. The proposal continues to give copyright applicants two opportunities to seek reconsideration of a Copyright Office decision to refuse registration. Comments are due on September 13. AMENDMENTS PROPOSED TO REGULATIONS PROVIDING FOR REPORTING OF USE OF SOUND RECORDINGS UNDER SECTIONS 114 AND 112

The Copyright Office proposes to adopt regulations specifying that the records of the use of sound recordings performed by means of digital audio transmissions during the period between October 28, 1998, and March 31, 2004, submitted by preexisting subscription services shall be considered the records of use for all services operating under the section 112(e) and section 114 licenses for that period. The Office proposes that no additional records need be filed by nonsubscription services, satellite digital radio audio services, or new types of subscription services. Comments are due on August 12.
