Copyright Claims Board: District Court Referrals; Proof of Service Forms; Default Proceedings; Law Student Representation


The Copyright Office has issued an interim rule and request for comments regarding Copyright Claims Board (CCB) procedures governing district court referrals, proof of service forms, default proceedings, and the appearance of law student representatives before the CCB.


The interim rule allows the CCB to modify or suspend certain rules when a claim is referred by a district court. The amendments also allow the CCB to accept alternative proof of service forms, clarify the rules governing default proceedings and law student representation, and make minor technical corrections.


Written comments were due February 2, 2023.


The Office plans to issue additional rules addressing unforeseen or new issues affecting CCB proceedings in the near future and encourages the public to provide feedback regarding the CCB’s regulations and operations at any time via the Office’s ex parte meeting process.
