Copyright Office Issues Final Rule for Small Claims Expedited Registration Procedures and FOIA Conforming Amendment

The U.S. Copyright Office has published a final rule establishing procedures for a new expedited registration option for a work at issue before the Copyright Claims Board (CCB), which is being established under the Copyright Alternative in Small-Claims Enforcement (CASE) Act. The rule enables a CCB claimant or counterclaimant with a pending copyright registration application to request expedited registration once the CCB proceeding has become active. The Office is adopting these changes to help facilitate access to alternative dispute resolution before the CCB. Additionally, the Office has adopted a conforming amendment to its Freedom of Information Act (FOIA) regulations. The amendment reflects the CASE Act’s direction that only those CCB “determinations, records, and information” that are published on the Office’s website and that relate to a CCB final determination are subject to disclosure under FOIA.
